And there is only way to be in the gang, and that is to pass an initiation ritual which includes at the very least aggravated assault, and at most rape, murder, etc. It is therefore impossible that any MS13 gang member is guilty of anything less than an aggravated assault. They should get at least a few years for that alone, by default and on sight, no jury should be needed. The gang tattoos themselves are the confession to at least a single felony.
